    If your goal is to get a collection agency off your back, or have some negative items removed from your credit report, you are going to have to write a few letters. Something that most people don't know is that the Federal Trade Commission, which is the Federal Agency that regulates credit reporting agencies, has dictated that the simple itemization of an account in a computer printout is not enough to serve as validation of a debt. Therefore, you need to demand that the collection agency provide you with original documents, or certified copies of a debt; under the law these are the only documents that acceptable for debt validation.
     
    Here is what you should be asking for:
     
    You need to ask the collection agency to provide you proof that they actually own the debt, or that it has been legally assigned to them for collection. This is extremely important since as all of us know, during the catastrophic banking failure that we experienced a few years ago, Banks were selling the mortgages and debts to each other so fast that they couldn't even determine who owned what. The law in on your side; use it.
     
    Ask for a certified copy of the statement from the original creditor. If you really want to get technical you can ask them to provide you with your complete payment history, and the original amount of the debt. If you are a good writer you can always cite case law: "Fields v. Wilber Law Firm, Donald L. Wilber and Kenneth Wilber, USCA-02-C-0072, 7th Circuit Court, Sept 2004."
     
    Origination documents; what are origination documents? These are the original documents that have your signature on the loan application, credit card, or any credit agreement that you have entered. A certified copy of your contract also serves to establish whether the account was legally assigned or transferred to another creditor or collection agency.
     
    Under the law you are entitled to receive a statement that itemizes the debts listed in your credit report and/or the payment history of a loan.
     
    Don't forget to ask for a copy of the agency's state and local licenses. If you find that the agency is not located in your state, demand that they provide you a copy of the license that allows them to do business in your state. If the collection agency is not properly licensed, your state laws may have regulations in place that prohibits the agency from attempting to collect from you.
     
    Under the law collection agencies only have 30 days to respond to your debt verification request letter or debt validation letter. If they fail to respond to you within the established time, write them another letter, and inform them that their failure to respond to your request is a violation of the The Fair Debt Collection Practices Act, section 809(b). You must also demand that the collection agency cease all collection activities and to immediately remove any entries that it may have sent to the credit reporting agencies.

    In the last article I told you about the first reason press releases get tossed in the trash. Let's move on to the second reason. The second reason press releases get trashed is that they are too self-serving.
     
    Far too many people think the purpose of doing media interviews is to get attention for themselves or make sales of their products. They think they can blatantly promote their products, the name of their business, the title of their book, etc. throughout the interview. DEAD WRONG! That's why they don't get publicity.
     
    A press release has one purpose and one purpose ONLY. That purpose is… to get the reporter to call you for more information! Then, the interviews you do have only one purpose. That purpose is… to make the reporter look good!
     
    Did you get that? If so, you're far ahead of the vast majority of people, since that vast majority still thinks that interviews are time for blatant sales pitches. But the smart people, the ones who know how to play the publicity game and make it pay, know that their job is to make the reporter (or interviewer) look good.
     
    The purpose of doing interviews is NOT to push your product. During the interviews you should be providing the reporter or talk show host with so much great information that they'll look great to their audiences. You may very well ask, "If I spend the interview time pumping out great information, how do I make sales?". Excellent question and one that's on the minds of many people who attempt to get publicity for their businesses or products. This is exactly where so many people go wrong when they stumble along trying to make sales using publicity. If you make the reporter look good by making his show or article interesting and exciting, he'll do a sales job for you far better than you could do yourself. If you try to pitch your own product you'll have two problems.
     
    First, the reporter or talk show host will probably cut your interview short and never interview you again. Second, you'll sound like the same old salesman that people are exposed to day and night. You'll simply sound like you're going for their wallet. On the other hand, if you do nothing but give out great information and the reporter or talk show host does the sales pitch for you, it's no longer really a sales pitch, is it? It's actually a very strong endorsement from someone the readers or listeners trust. Do they trust you? Heck no.
     
    Do they trust the reporter or talk show host? You bet. Otherwise they wouldn't still be reading their column or listening to their show. Reporters, talk shows hosts, etc. have spent years building strong relationships with their audiences. When you do interviews and you make the interviewer look good to his audience, he's going to be willing to share that good will he's built up over the years. That's a HUGE benefit!     Many people have excellent stories, but they never get picked up by the media. There are three main reasons for this. In this article I'll focus on the first reason. I'll cover the other two in future articles.
     
    When you send a reporter a press release, you're actually doing two things. First, you're sending him news about your story, trying to interest him in calling you. You do this with the words you put in your release. Second, and more importantly, you are sending signals to the reporter that let him know whether or not you really know how to play the publicity game. What signals are you sending and how are you sending them?
     
    Probably the most obvious signal is in the way your press release looks. I don't mean how it reads. I mean how it looks. Is the page set up the right way? When the reporter looks at your press release, before he even reads one word, does it look right? If it does, the reporter keeps reading. If not, it goes in the trash.
     
    Why such harsh treatment? You may have a very exciting story. Is it really fair that because you didn't lay out your press release the right way that it should be trashed? Yes! Reporters get dozens if not hundreds of press releases every day. Plenty of these releases have exciting stories. So the reporter can pick and choose which ones he wants to follow up on.
     
    If you didn't know enough about press releases and publicity to lay out the release correctly, the reporter is going to assume there's a lot more about publicity you don't know. For example, how to do an interview. So, the reporter scraps your release and moves on to the next one that is laid out correctly. That may not be as exciting a story as yours. But the person writing it has sent clear signals to the reporter that he knows how to play the game.
     
    Reporters don't have time to teach you how the publicity game is played. That's up to you (and me). Once you learn how to play the game – which includes how to write and lay out a press release, bio sheet and q&a sheet, how to answer the "quiz" questions the reporters will ask you when they first call you, how to book your interview with him and how to do the interview – reporters from around the world will be thrilled to give you all the publicity you can handle.
     
    Until you take the time to learn the rules of the game, no reporter is going to waste his time coaching you through the process. (That's my job!) So, the first reason your press release may be trashed is that it didn't look right and you sent signals to the reporter that you don't know how to play the publicity game. It's a game that's easy to learn and one that can bring you fame and fortune so far beyond anything you could imagine you'll wonder why you didn't learn it sooner. That's it for this article.
